TERMS AND CONDITIONS OF ORDER FOR TAKING AWAYS RuBaRu Restauracja Indyjska


I. GENERAL PROVISIONS
1. These regulations, hereinafter referred to as the Regulations, specify the rules for the provision of services on the website www.rubaru.eu, the rules for the use of services and the rules for the protection of Users' personal data.
2. The administrator of your data is the LOBO company, the owner of the RuBaRu Restaurant, registered in the register of entrepreneurs, NIP: 556-001-61-05, REGON number: 090553909, e-mail: lobo-inowroclaw@wp.pl
4. Enabling the use of the Website is a service provided electronically by the Service Provider to Users, within the meaning of the Act of 18 July 2002 on the provision of electronic services (Journal of Laws of 2002, No. 144, item 1204, from as amended), which takes place on the basis of a contract concluded between the Service Recipient and the Service Provider and pursuant to the Regulations.
5. The Regulations apply to all services provided on the Website, excluding services subject to separate regulations. The Service Provider specifies on the Website what types of services are provided on the basis of separate regulations.
6. Buyers are required to read the Regulations before using the Website. Starting to use the Services is tantamount to full acceptance of the Regulations.
7. The Service Provider provides the Regulations free of charge via the website www.rubaru.eu. Users before concluding the Agreement in the ICT system, as well as in a way that allows its downloading, consolidation and printing.
8. From the moment you start using the services, everyone is obliged to comply with the regulations.
 
II. DEFINITIONS
Service provider - the company LOBO, owner of the RuBaRu Restaurant, registered in the register of entrepreneurs, NIP: 556-001-61-05, REGON number: 090553909,
e-mail: lobo-inowroclaw@wp.pl.
User - a natural person with at least limited legal capacity, a legal person, an organizational unit without legal personality that uses the services provided by the Service Provider, pursuant to the Regulations.
Restaurant - a restaurant, which is part of the LOBO company, which offers its products on the website www.rubaru.eu.
Services - services provided electronically by the Restaurant to Users based on the Regulations.
Agreement - an agreement concluded between the User and the Service Provider, authorizing the User to use the Internet market and products and services made available by the Service Provider in accordance with the conditions set out in these Regulations
 
III. TERMS OF SERVICE PROVISION BY THE SERVICE PROVIDER
1. The Service Provider makes every effort to ensure that the information presented on the Website regarding individual offers and geographical regions in which the Services are provided are as current as possible, however it may happen that a given product will be temporarily unavailable. The Service Provider undertakes to inform the User about it as soon as possible, no later than 90 minutes after placing the order.
2. If the electronic payment option is selected, the order is deemed to be successfully placed when the Service Provider receives a positive authorization response from the Payment System, about which the Service Provider informs the User by displaying an appropriate message on the screen. If a negative authorization response is received, the order cannot be processed, of which the User is immediately informed by a message on the screen. If the Service Provider receives a positive authorization response and the Service Provider fails to process the order, the User is obliged to immediately inform the Service Provider by e-mail at the address in the contact tab.
3. In the event of a positive transfer of the order, the User shall receive information by electronic means to the e-mail address provided with the order details and the contact details of the Restaurant.
4. Withdrawal of the order is only possible by phone to the restaurant's telephone number, available at: www.rubaru.eu. Exceptions are restaurant invitations, in which case you should contact PR Manager. The User is obliged to inform the Restaurant / Manager about resignation from the order immediately after receiving the order confirmation.
5. It is not possible to change the content of the order placed.
 

IV. PAYMENT
1. The User may make a payment in cash on delivery carried out by the Service Provider (if the order is selected with personal pickup) or via online payments. Settlements of transactions by credit card and e-transfer are carried out via Dotpay.pl.
2. All prices on the website include VAT (value added tax).
3. All electronic payments are made in accordance with the applicable regulations of the Payment System Operator or Payment System partner, and the Service Provider is not responsible for their correctness.
4. Cash payment is made to the supplier of the ordered products, against receipt. If it is not possible to positively submit the order to the Restaurant, the User will receive a refund of the entire payment made via the Payment System from the Service Provider. The Service Provider will return the payment no later than 72 working days from the date the Service Provider receives information about the failure to perform the order for the reasons referred to in this point (in the case of payment by bank transfer) and up to 14 working days in the case of payment by card. The date of refund is the date on which the Service Provider submits an instruction to return the amount due to the Payment Operator.
4. Payment System Partners and the Payment System Operator reserve the right to refuse to handle payments made by the User, in particular in the event of doubts as to the legality of the transaction for which the payment is made or the legality of the payment itself. For the above reasons, the Service Provider may refuse payment.
5. The Payment System Operator shall not be liable for delays in transferring payments or authorization responses, caused by reasons arising after the User submits a payment order, as well as for failure to complete and delay in the transfer of due funds or data verification, in particular caused by incorrect or incomplete delivery by the User. data that prevent the execution of payment transactions, as well as for delays resulting from other events beyond the control of the Service Provider or the Payment System Operator.
 
V. COMPLAINTS PROCEDURE
1. The User has the right to lodge a complaint with the Service Provider regarding matters regarding the Services.
2. Complaints regarding Services shall be considered by the Service Provider.
3. A correctly submitted complaint regarding the Services should contain at least the following data:
3.1. User's data (name, surname, e-mail address)
3.2. subject of the complaint;
3.3. circumstances justifying the complaint.
Complaints not containing the above data will not be considered. Complaints should be submitted to the e-mail address of the restaurant: rubaru@rubaru.eu, with the subject of the message: "Complaint"
4. The Service Provider will endeavor to process complaints within 14 days of their receipt from the User. The User shall immediately notify the User about his decision made as a result of consideration of the complaint via e-mail to the e-mail address provided in the complaint
